Plain-language summary
- You are the seller, and you are responsible for what you sell: that it exists, that it is legal, that it arrives, its warranty, its returns, and its refunds.
- To get paid within Cashwing, you connect your own payout account (Stripe or another authorized payment gateway). Cashwing charges its commission and holds the payment until delivery is confirmed.
- You must provide your real information and honor the right of withdrawal and the warranty required by the law of your customer's country.
1. Scope
These terms apply, in addition to the Terms and Conditions, to anyone who lists products, services, courses or digital products, stores, restaurant reservations, accommodations (Stays), rides (Drivers), installment plans (Total Cuota (installment plan) / Plan Separe (layaway)), or any commercial offer.
2. Requirements
2.1. Be over 18 years of age with legal capacity to contract, or be a duly represented company. Minors under 18 may run a business as collaborators of the store of their mother, father or legal guardian, as set out in section 3.3 of the Terms and Conditions.
2.2. Provide truthful and up-to-date information: name or legal business name, country and city, business contact phone number and email and, when required by law or by the payment processor, identification, tax information, and bank account.
2.3. To collect card payments within Cashwing, you must connect and verify your own account with the payment processor (for example, Stripe). You also accept that processor's terms.
2.4. High-volume sellers in the United States (INFORM Consumers Act): if you exceed the thresholds set by the law, Cashwing will request and verify additional information from you each year and may display your name and contact information to buyers. If you do not provide it on time, we may suspend your sales.
2.5. Colombia (Ley 1480 de 2011, Colombian Consumer Protection Statute, e-commerce): you must disclose your name or legal business name, identification (NIT (Colombian tax ID number) or cédula (Colombian national ID card)), address for notices, phone number, and email, and Cashwing may display them to your buyers so they can file claims.
3. What you must disclose before the sale
Total price (including taxes and fees), currency, features, condition (new or used), real photos, delivery time and method, warranty, return policy and, if applicable, that the product is not subject to withdrawal and why (for example, perishable or personalized). Hidden fees, false reference prices, false scarcity, and offers without inventory are prohibited.
4. Your obligations
- Deliver what you sold, within the time and in the manner advertised, and keep proof of shipment or delivery.
- Respond to your buyers' messages and claims promptly and in good faith.
- Honor the legal warranty (quality, fitness, and safety) and returns.
- Honor the 5-business-day right of withdrawal of consumers in Colombia and refund the money within the following 30 days, as well as the payment reversal when applicable.
- Comply with the laws governing your activity (licenses, permits, health and sanitation, insurance, transportation, tourism, taxes).
- Do not sell prohibited items (see Community Guidelines and Prohibited Items).
- Use your buyers' data only to fulfill the purchase, the warranty, and your legal duties. You may not sell it or add it to advertising lists without their consent.
5. Payments, commissions, and payment protection
5.1. Cashwing charges the commission disclosed on the Platform (general or by country) on each sale paid within Cashwing. The commission is automatically deducted from the payment.
5.2. The buyer's payment is held by the processor until the buyer confirms, delivery is confirmed, or the disclosed period expires (see Refund Policy). It is then transferred to your account according to the processor's timelines.
5.3. If the buyer files a claim in time, the payment is frozen. Cashwing will review the evidence from both parties and may order a full or partial refund charged to your account. If your account does not have a sufficient balance, the processor may deduct it from future payments.
5.4. You are responsible for chargebacks (disputes from the buyer's bank) and for providing the evidence requested by the processor.
5.5. Sales collected outside Cashwing (cash, transfer, your own payment gateway) are your sole responsibility. When the Platform so indicates (for example, installments collected at your place of business), you must pay Cashwing the corresponding commission.
6. Total Cuota and Plan Separe
If you offer payment in installments, you are financing the sale. You must clearly disclose the down payment amount, the number and amount of the installments, and the dates; you may not charge interest or undisclosed surcharges. Cashwing organizes the plan and the reminders, but it is not a lender and does not guarantee that the buyer will pay.
7. Affiliates, Cash Winner, and Master
If you allow affiliates, you agree to pay the commission you chose on sales that come through their links. If your business has a Cash Winner or Master, they earn a portion of what Cashwing charges, not of your price; anything you agree to separately with them (for example, a management fee) is a direct arrangement between you in which Cashwing does not participate.
8. Regulated services
Drivers, hosts, and professionals in health, law, finance, insurance, tourism, or housing must hold the licenses, permits, and insurance required by law and show them when asked. Being on Cashwing does not mean that Cashwing provides, supervises, or guarantees the service.
Drivers: the driver is independent and is responsible for their license, vehicle, insurance, transportation permits, and the safety of the ride. Cashwing is not a transportation company.
Stays: the host is responsible for the accommodation, its safety, its permits, and lodging taxes, and must always offer a benefit to the community, as indicated by the Platform.
9. Reviews
Reviews must be genuine. It is prohibited to buy or fabricate reviews, to offer something in exchange for a positive review without disclosing it, or to retaliate for an honest review.
10. Cashwing's measures
We may reject or remove listings, request documents, pause or suspend stores, hold payments while fraud is investigated, notify buyers, remove dangerous products, and close accounts. When possible, we will tell you the reason, and you may explain or appeal at services@cashwing.net.
11. Indemnification
You will hold Cashwing harmless from claims, fines, or damages caused by your products, services, listings, taxes, or breaches, to the extent permitted by law.
12. Disputes with Cashwing
Disputes between Cashwing and sellers established in the United States will be resolved by individual arbitration under the Commercial Rules of the American Arbitration Association, in Orange County, Florida, without class actions. For sellers in Colombia, Colombian law and the courts of Bogotá apply, unless the law provides otherwise.
13. Survival
These obligations (payments, taxes, data, warranties, indemnification, and evidence) remain in effect after you close your store or your account.
