- Cashwing is a technology platform. It connects people, stores, drivers, hosts, creators, and customers. When you buy something from a seller, the purchase agreement is between you and that seller, not with Cashwing.
- The seller is responsible for what it sells: quality, delivery, warranty, returns, and refunds. Cashwing helps you file a claim and protects your payment while delivery is confirmed, as described in the Refund, Return, and Withdrawal Policy.
- You must be at least 13 years old to use Cashwing and 18 years old to sell, get paid, buy advertising, or earn commissions in your own name. Young people aged 13 to 17 can run a business as collaborators of their mother's, father's or legal guardian's store.
- Your content is yours. You give us permission to display it within the service according to the choices you make.
- We keep proof that you accepted these terms: date, time, IP address, device, language, and the exact version of the text.
- If you live in Colombia, you have all the rights under Ley 1480 de 2011 (Colombian Consumer Protection Statute) (including the 5-business-day right of withdrawal) and Ley 1581 de 2012 (Colombian Personal Data Protection Law). If you live in the United States, the Arbitration Agreement applies, and you may opt out of it within 30 days.
1. Who we are
1.1. Cashwing (the social network, the Marketplace, ChatWing, and the other features, hereinafter the "Platform") is operated by CASHWING LLC, a limited liability company of Florida, United States (Windermere, Orange County) (hereinafter "Cashwing," "we," "us").
1.2. For people residing in Colombia, the Platform is offered through CASHWING COLOMBIA S.A.S., a Colombian company domiciled in Bogotá D.C., Colombia, which acts as the controller of personal data and as the local counterparty. In these Terms, "Cashwing" includes the entity that applies based on your country.

2. Acceptance and documents that make up this agreement
2.1. When you create your account, you must check two boxes, neither of which is pre-checked: one to accept these Terms and Conditions and another to accept the Privacy and Data Processing Policy. An account cannot be created unless both are checked. That act has the same effect as your signature, to the extent permitted by law.
2.2. These Terms incorporate by reference the following documents, all available at all times in the Legal Center:

2.3. Proof of acceptance. Cashwing keeps a record of each acceptance with: your account, the date and time, the IP address, the browser or device, the language, the screen where you accepted, the text of each checkbox, the document version, and a digital fingerprint (hash) of the exact text. That record cannot be edited or deleted from the Platform and may be used as evidence in any claim or before any authority or court. You can see what you accepted in My Profile → Accepted legal documents.
2.4. Changes. If we change something important, we will notify you reasonably in advance within the Platform or by email and, when the law or the change requires it, we will ask you to accept again. Previous versions remain published with their date. A change never applies to a claim you have already submitted to us.
3. Who can use Cashwing
3.1. You must be 13 years of age or older (or any higher minimum age required by your country). If you are between 13 and 17 years old, you need the authorization of your mother, father, or legal guardian, who accepts these documents on your behalf; in Colombia this authorization is required by law.
3.2. Only individuals over 18 years of age with legal capacity to contract (or duly represented companies) may sell, offer services, charge, receive payments or commissions, buy advertising, be a Cash Winner or Master, list accommodations, or work as a driver.
3.3. Young entrepreneurs (ages 13 to 17). Cashwing supports youth entrepreneurship. A minor may help run a store, post its products and serve customers as a collaborator of the store of their mother, father or legal guardian, who is the holder of the store and of the payout account, receives the money, authorizes the minor's participation and is responsible for it. The minor may not have their own payout account, receive payments or commissions in their own name, buy advertising, or be a driver or host.
3.4. You must provide truthful information and keep it up to date. Anyone acting on behalf of a company represents that they have the authority to bind it. We may request verification of identity, age, representation, licenses, or tax information before enabling higher-risk features.
3.5. Your account is personal. Protect your password, do not share or sell it, and let us know if someone accesses it without your permission. We may preventively block an account if there are reasonable signs of theft, fraud, or risk.
4. What the Platform is
4.1. Cashwing offers, among other features: a social network (Wall, profiles, communities, and Clubs), ChatWing messaging, the Marketplace and stores, digital products and courses, installment sales through Total Cuota (installment plan) and Plan Separe (layaway), Restaurants reservations, Drivers (transportation with independent drivers), Stays, third-party deliveries, games and activities (Win10, Situations, Collectibles), savings and goal tools, the artificial-intelligence-powered Cashwing Companion, advertising, and commission programs (affiliates, Cash Winner, and Master).
4.2. Not all features are available in all countries. The fact that you can open the Platform from a country does not mean that all features are offered there.
4.3. The Platform is provided "as available." We may improve, change, limit, or withdraw features, and perform maintenance. We will notify you of important changes when reasonable.
5. The Marketplace: Cashwing is not the seller
5.1. The products, services, courses, trips, reservations, and accommodations listed by other users are offered and sold by them. Unless a listing expressly states that the seller is Cashwing (for example, the CashWing Official Store or Cashwing's own subscriptions), Cashwing is not the seller, manufacturer, importer, service provider, carrier, or a party to the purchase agreement.
5.2. The seller is responsible for: its identity, that the product exists and belongs to it, that it is legal and safe, the description and photos, the total price, taxes, delivery, warranty, returns, withdrawal, and refunds. The details are in the Seller Terms.
5.3. So that you can file a claim, the Platform shows you who the seller is and lets you contact them through ChatWing. If you are a consumer in Colombia, Cashwing complies with the duties that Ley 1480 de 2011 assigns to contact portals, including identifying the seller and providing a mechanism to file claims. This clause does not eliminate any liability that the law imposes directly on Cashwing.
5.4. Payment protection. For purchases paid by card within Cashwing, the money is not delivered to the seller immediately: it is held by the payment processor until you confirm that you received your order, until the seller marks it as delivered and the claim period expires, or at most for the period disclosed at the time of purchase (usually 7 days). If you report a problem within that period, the payment is frozen until the issue is resolved. The full rules are in the Refund Policy.
6. Payments, commissions, and Cashwing Balance
6.1. Payment processors. Card payments are processed by Stripe (and in Colombia by the local payment gateway that is enabled). Cashwing never sees or stores your full card number. Each seller collects payment through its own account with the processor; Cashwing receives only its commission.
6.2. Commissions and fees. Before you pay for anything, you will see the total price. The commissions that Cashwing charges sellers, advertisers, and providers are disclosed before they are charged.
6.3. Cashwing Balance. It is a prepaid balance that can be used only to pay Cashwing for the Platform's own services (plans, advertising, commissions, subscriptions). It is not a deposit, does not earn interest, cannot be transferred to other people, cannot be used to buy from other users, and is not electronic money. You may request a refund of any unused balance by writing to services@cashwing.net; it is refunded through the same method used to pay, deducting only the processor's costs where permitted by law.
6.4. Savings, goals, and Savings Club. These are tools to organize, track, and encourage saving. Cashwing does not take money from the public, does not accept deposits, and does not pay interest. When a group decides to save together, the money is handled among its participants, under their responsibility, unless the feature expressly identifies an authorized payment provider.
6.5. Total Cuota and Plan Separe. When a business offers payment in installments, the business is the one providing the financing, not Cashwing. Cashwing does not lend money, does not charge interest on installments, and is not a financial institution. The Platform organizes the plan, the reminders, and, if you choose, automatic charges to your card. Your payment behavior generates a rating that may allow (or prevent) you to buy in installments from other Cashwing businesses.
6.6. Cashwing subscriptions. Store plans, the Companion, and other Cashwing services renew automatically if so indicated at the time of purchase, until you cancel them. You may cancel at any time from the Platform; cancellation prevents future charges. Refunds for Cashwing's own services are governed by the Refund Policy.
6.7. Taxes. Each seller, provider, or person earning commissions is responsible for their own taxes.
7. Commission programs: affiliates, Cash Winner, and Master
7.1. You can earn commissions by sharing products (affiliates), helping businesses (Cash Winner), or building a team (Master), according to the current rate tables shown on the Platform. No simulator, example, or presentation is a promise of income: what you earn depends on actual sales.
7.2. Those who participate in these programs are independent: they are not employees, agents, or representatives of Cashwing, cannot bind Cashwing, and must comply with advertising laws, including disclosing that they earn a commission when they recommend something.
7.3. Commissions are paid only on sales that have been paid and not refunded. If a sale is refunded or a chargeback is lost, the commission is reversed, even if it has already been paid. To receive payments, you must have a verified payout account with the payment processor.
7.4. Self-purchases, fake referrals, duplicate accounts, and any trick to generate commissions are prohibited. They may result in the loss of commissions and the closure of the account.
8. Your content and your image
8.1. What you post remains yours. For the Platform to work, you grant us a worldwide, non-exclusive, royalty-free, and limited license to host, store, display, technically adapt, and distribute your content within the Platform, to the audience you choose. The license ends when you delete the content, except for backup copies, evidence, legal obligations, or what other people have legitimately shared.
8.2. We do not use your name, photo, or video in advertising outside the Platform without your express and separate permission. The details are in Image and Content Rights.
8.3. You represent that you hold the rights and permissions for what you post (photos, music, trademarks, other people's likenesses), and you are responsible for it.
9. What is not allowed
It is prohibited to use Cashwing for fraud, scams, impersonation, harassment, threats, exploitation of minors, illegal content, prohibited items, spam, mass data extraction, viruses, manipulation of reviews or commissions, evading blocks, or any conduct described in the Community Guidelines. We may remove content, limit features, suspend or close accounts, preserve evidence, and cooperate with authorities. When possible, we will tell you the reason, and you may appeal by writing to services@cashwing.net.
10. Artificial intelligence
Some features use artificial intelligence (for example, the Cashwing Companion and the assistants for writing descriptions or courses), with providers such as Anthropic. AI responses may be wrong and are not medical, psychological, legal, financial, or tax advice. The Companion is a computer program, not a person. If you are in crisis, seek help immediately: in the United States, call or text 988; in Colombia, call Línea 192 (option 4) or 123.
11. Third-party services
Payments, deliveries (for example, Uber Direct), maps, embedded videos (YouTube, Vimeo), links to other platforms, and other services may have their own terms. Cashwing does not control those services, although it chooses reputable providers and complies with its own legal obligations.
12. Cashwing's property
The software, the design, the CASHWING and ChatWing trademarks and their logos, and the databases belong to Cashwing or its licensors. We grant you a personal, limited, revocable, and non-transferable license to use the Platform. You may not copy it, reverse engineer it, extract data in bulk, or use unauthorized bots.
13. Account closure
13.1. You may stop using Cashwing and delete your account at any time from My Profile → Delete my account. Some records are kept when required by law (sales, payments, taxes, proof of acceptance, fraud prevention).
13.2. We may suspend or close an account for breach, fraud, risk, an order from an authority, or prolonged inactivity. In the event of serious danger, we may act without prior notice; in other cases, we will try to notify you and give you the opportunity to explain.
14. Warranties and limitations of liability
14.1. To the extent permitted by law, the Platform is offered "as is" and "as available." We do not guarantee that it will operate without interruption, nor do we guarantee sales, income, or results.
14.2. Cashwing is not liable for the independent acts of sellers, buyers, drivers, hosts, creators, or other users that are beyond its reasonable control, nor for third-party products or services. It is liable for its own obligations when required by law.
14.3. To the extent permitted by law, Cashwing is not liable for indirect damages, lost profits, or loss of opportunities. For consumers, Cashwing's total liability will not exceed the greater of USD 100 and the amount you paid directly to Cashwing in the preceding 12 months; for business users, the greater of USD 500 and the amount paid during that period. These limits do not apply to willful misconduct, gross negligence, personal injury caused by Cashwing, or anything the law prohibits limiting.
14.4. Nothing in these Terms reduces the rights that the law grants you as a consumer and that cannot be waived (information, warranty, withdrawal, payment reversal, privacy, recourse to the authorities). If a clause conflicts with a mandatory rule, the rule applies.
15. Indemnification by business users
Sellers, advertisers, drivers, hosts, creators, and those who earn commissions will hold Cashwing harmless from claims caused by their products, services, ads, content, taxes, or breaches, to the extent permitted by law. This obligation is not imposed on consumers where it would be abusive.
16. Claims and dispute resolution
16.1. With a seller: first, write to them through ChatWing. If the issue is not resolved, use "Report a problem" in My Purchases before the payment is released, or write to us at services@cashwing.net. Cashwing will review the evidence and may order a refund through the payment processor in accordance with the Refund Policy.
16.2. With Cashwing: write to us at services@cashwing.net stating your name, account, the facts, and what you are requesting. We will respond within 15 business days.
16.3. If you reside in the United States, disputes with Cashwing are resolved through individual arbitration under the Arbitration Agreement, with a waiver of jury trial and class actions, unless you opt out within 30 days after your first acceptance. You may always go to small claims court and to government agencies.
16.4. If you reside in Colombia, you may go to the Superintendencia de Industria y Comercio (SIC, Colombia's consumer and data protection authority) and to the courts of Colombia. No arbitration clause or foreign law takes those rights away from you.
16.5. In other countries, the mandatory rights of your country of residence apply.
17. Governing law
For United States residents: federal law and, otherwise, the law of the State of Florida, without depriving you of the mandatory rights of your state. For residents of Colombia: Colombian law. For everyone else: the law of Florida, without prejudice to the mandatory rights of your country.
18. Language
These documents are published in Spanish, English, and Portuguese, and all three versions say the same thing. If there is any discrepancy, the Spanish version prevails for Colombia, the English version prevails for the United States, and, in other countries, the version in the language in which you accepted prevails, without ever depriving you of a mandatory right.
19. Final provisions
If a clause is found to be invalid, the others remain in effect. Failure to exercise a right does not mean waiving it. You may not assign your account or this agreement without authorization; Cashwing may assign it in a reorganization or sale of the business, respecting your rights and the Privacy Policy.
